PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE LISTEDLOW SERVICE. BY ACCESSING OR USING OUR WEBSITE, APPLICATIONS, OR SERVICES (COLLECTIVELY, THE “SERVICE”), YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (“TERMS”). IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.
1. ACCEPTANCE OF TERMS
1.1 These Terms form a legally binding agreement between you (“User,” “you,” or “your”) and ListedLow (“Company,” “we,” “us,” or “our”).
1.2 By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as any other policies referenced herein (including our Privacy Policy).
2. ELIGIBILITY
2.1 You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service.
2.2 By using the Service, you represent and warrant that:
a) You have the legal capacity to enter into a binding contract;
b) All information you provide is current, accurate, and complete;
c) You will maintain the accuracy of such information;
d) Your use of the Service does not violate any applicable laws or regulations.
3. DESCRIPTION OF THE SERVICE
3.1 ListedLow is a data-driven real estate platform offering Users daily property lists featuring residential properties identified as below market value (“Property Listings”).
3.2 Key features of the Service include, but are not limited to:
a) Daily Property Listings: Emailed spreadsheets containing below-market-value properties, updated twice daily, with a maximum delay of 12 hours.
b) Property Valuation Insights: Information regarding list prices, estimated market values (including estimates from HouseCanary® and other AVMs), three-year value forecasts, potential offer price suggestions, and standardized property condition codes (C1-C6).
c) Comprehensive Property Data: Listing details (address, MLS ID, listing date), property specs, taxes and fees, ownership history, mortgage information, estimated rent potential, zoning codes, legal descriptions, and days on market (DOM).
d) Customization & Data Access: Filtered reports, multiple file formats (CSV, XLS, PDF), additional data upon request, and daily real estate data automation and coverage across U.S. residential listings.
e) Subscription Plans: City Plan ($49/month), State Plan ($99/month), and Nationwide Plan ($349/month). All plans are month-to-month, with downloadable files remaining active for three months.
3.3 We reserve the right to modify or discontinue any part of the Service at any time, without prior notice.
4. SUBSCRIPTIONS, FEES, AND PAYMENT
4.1 Subscription Plans
a) Monthly subscriptions are available as City, State, or Nationwide Plans.
b) Subscriptions renew automatically each month unless canceled prior to the renewal date.
4.2 Billing
a) By enrolling in a subscription, you authorize us (or our third-party payment processor) to charge the subscription fee to the payment method provided.
b) If payment is not successfully settled for any reason, we may suspend or terminate your subscription.
4.3 Refund Policy
a) We offer a full money-back guarantee within the first week of subscription if you are not satisfied with the Service.
b) After the first week, refunds are not guaranteed and will be considered on a case-by-case basis.
4.4 Plan Changes
a) You may upgrade, downgrade, or switch plans at any time through your account settings or by contacting our support team.
b) Upgrades or downgrades may result in prorated charges for the billing period.
4.5 Cancellation
a) You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle, and you will not be billed for subsequent periods.
b) Canceling your subscription does not entitle you to a full or partial refund, except as outlined in our Refund Policy above.
5. USER ACCOUNT AND RESPONSIBILITIES
5.1 Account Creation
a) To access certain features, you may be required to create an account.
b) You are responsible for providing accurate information during registration and for updating this information as changes occur.
5.2 Confidentiality
a) You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
b) You must notify us immediately of any unauthorized use of your account or any other breach of security.
5.3 Prohibited Conduct
You agree not to:
a) Use the Service in any way that violates applicable laws or regulations;
b) Copy, modify, distribute, sell, rent, lease, sublicense, or otherwise transfer any part of the Property Listings or related data except as authorized in these Terms;
c) Impersonate or misrepresent your affiliation with any person or entity;
d) Engage in any activity that disrupts or interferes with the Service’s operation or security.
6. DATA USAGE AND INTELLECTUAL PROPERTY
6.1 Ownership
a) All content, data, listings, text, graphics, logos, and software made available through the Service (collectively, “Content”) is the property of ListedLow or its licensors and is protected by intellectual property laws.
6.2 License
a) Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Content for your personal or internal business purposes.
b) You may download, export, and use the daily reports, listings, and data solely for your own investment research and due diligence.
6.3 Restrictions
a) You may not reproduce, distribute, or publicly display any Content or data from the Service for commercial purposes without our express written permission.
b) You may not use any trademarks, logos, or service marks displayed in the Service without our (or the applicable third party’s) prior written permission.
7. DISCLAIMER OF REAL ESTATE AND INVESTMENT INFORMATION
7.1 No Investment Advice
a) The information provided by ListedLow is for informational purposes only and should not be construed as investment, financial, or real estate advice.
b) You agree that you are solely responsible for any decisions or actions you take based on the information provided through the Service.
7.2 Accuracy of Data
a) ListedLow aggregates data from multiple sources, including MLS databases, lending institutions, valuation providers (like HouseCanary®), and public records. We endeavor to provide accurate data but do not guarantee the completeness, reliability, or accuracy of any Content.
b) Market conditions can change rapidly, and listed properties may be withdrawn, sold, or modified. The Service is updated twice daily with a maximum delay of 12 hours, but no guarantee is made that it will reflect real-time market conditions.
7.3 No Guarantee of Results
a) Estimated market values, potential offer prices, and three-year value forecasts are projections based on historical data and automated valuation models. They are subject to change and do not guarantee future performance or property valuations.
b) You acknowledge that any real estate investment involves risk, and ListedLow is not liable for any losses or damages arising from your reliance on the data provided.
8. DISCLAIMER OF WARRANTIES
8.1 THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTEDLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
8.2 LISTEDLOW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
8.3 ANY MATERIAL OR DATA OBTAINED THROUGH THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK. LISTEDLOW IS NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING FROM THE DOWNLOAD OR USE OF SUCH MATERIAL.
9. LIMITATION OF LIABILITY
9.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LISTEDLOW, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, DATA LOSS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE.
9.2 IN NO EVENT SHALL LISTEDLOW’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU PAID TO LISTEDLOW IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9.3 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS ON LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU.
10. THIRD-PARTY CONTENT AND EXTERNAL LINKS
10.1 The Service may include hyperlinks to third-party websites or resources. ListedLow does not endorse and is not responsible or liable for the availability or accuracy of such external sites or resources, or the content, products, or services on or available from such websites or resources.
10.2 Your interactions with third-party websites, entities, or individuals found through the Service are solely between you and those entities or individuals. ListedLow shall not be responsible or liable for any loss or damage arising from such interactions.
11. INDEMNIFICATION
11.1 You agree to defend, indemnify, and hold harmless ListedLow, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, or debt, and expenses (including attorneys’ fees) arising out of:
a) Your use of and access to the Service;
b) Your breach of any of these Terms;
c) Your violation of any applicable law or the rights of any third party.
12. TERMINATION
12.1 We reserve the right to suspend or terminate your access to the Service at any time, with or without prior notice, for any reason, including but not limited to your breach of these Terms.
12.2 Upon termination of your account, your right to access and use the Service shall immediately cease. Any provisions in these Terms that by their nature should survive termination (e.g., intellectual property rights, warranty disclaimers, indemnity, and limitations of liability) shall survive.
13. MODIFICATIONS TO THE TERMS
13.1 ListedLow reserves the right to update or modify these Terms at any time.
13.2 If we make material changes, we will notify you by email (using the address associated with your account) or by posting a notice within the Service before the changes become effective.
13.3 Your continued use of the Service after the effective date of any modified Terms constitutes your acceptance of the revised Terms.
14. GOVERNING LAW AND DISPUTE RESOLUTION
14.1 These Terms and any dispute arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of the state or jurisdiction where ListedLow is primarily located, without regard to conflict of law principles.
14.2 Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in that same jurisdiction, and you consent to the jurisdiction of such courts.
15. SEVERABILITY
15.1 If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permissible under law.
16. ENTIRE AGREEMENT
16.1 These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and ListedLow regarding your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
